Group Leader Liability Guidelines
The clearest guidance that our organization has received from non-profit lawyers regarding Group Leader liability can be summarized as follows:Leaders are responsible for what they say and do and what they encourage other people to say and do. If an attendee at your event does something that falls outside what you have said or encouraged others to do, the liability (for breaking a window, for example) now falls on them, not you.
This underscores the importance of thinking intentionally about what we write in our event descriptions, newsletters, and signage, as well as what we say when leading events. The more clearly we set boundaries between appropriate and inappropriate speech and behavior, the safer we all are and the less exposure leaders have to liability risk.
We encourage all Group Leaders to think ahead about possible pitfalls, obstacles, and dangers related to every event they plan, and to take preventive measures and use clear language to guide attendees appropriately. For example:
If weather conditions are hazardous, postpone the event or advise participants to "dress appropriately for hot weather".
If health concerns exist, like air quality (check AirNow app) or high viral transmission rates, encourage appropriate precautions like masking or social distancing.
If you're near traffic or other hazards, be specific about where people should and should not stand.
Always direct people to "come to the check-in table or talk to our marshals if you have any questions or see anything of concern".
Make marshals easily identifiable with orange armbands or yellow vests so attendees can come to them with concerns or questions that might arise during your action or event.
Remember: thoughtful planning and clear communication are your best tools for creating safe, successful events while protecting yourself and our organization.
